Consent to remote access
I acknowledge and agree that, by entering into this remote support session, I am granting eircom remote access to and control over my computer. I hereby consent to eircom using this access and control for one or more sessions (each, a "Session") for the purpose of evaluating and addressing issues affecting the installation and/or operation of the eircom products I have. In granting this consent, I agree as follows:
I represent and warrant that I own the computer on which I will install the Applet, or I otherwise have authority to grant eircom access to and control over the computer as contemplated by this Consent.
During the Session, eircom will perform whatever functions eircom considers reasonably necessary or appropriate to accomplish the goals of the Session. These activities may include, among other things, copying, moving, overwriting and deleting files; running diagnostic and repair programs; accessing software and system information needed to investigate and resolve problems; rebooting my computer and reestablishing the Session.
The Session may be recorded for quality assurance purposes and such recordings will be used only for this specific purpose. For my security, the Session will be encrypted at all times and cannot be accessed by any third party.
I may be asked by an eircom Service Representative to disable my firewall and other security hardware and software to enable eircom to control my computer. I understand it is my responsibility at the end of the Session to restore these security features to their prior settings.
I may interrupt the Session at any time by clicking on the "Disconnect" button on the dialog box or pressing the Pause/break key on my computer keyboard, doing so may prevent eircom from completing its work, leave eircom software or other programs inoperative and/or leave my computer in an unstable condition.
eircom represents and warrants that it will exercise reasonable care and judgment in attempting to complete its work during the Session. EIRCOM MAKES NO OTHER WARRANTIES WITH RESPECT TO ANY SESSION OR THE WORK PERFORMED DURING ANY SESSION. EIRCOM SPECIFICALLY DISCLAIMS ANY REPRESENTATION OR WARRANTY THAT ACTIVITIES DURING THE SESSION WILL BE SUCCESSFUL, THAT IT WILL CORRECT ANY OR ALL DEFECTS, PROBLEMS OR ISSUES WITH ANY SOFTWARE, HARDWARE OR SYSTEM, OR THAT THE OPERATION OF ANY SOFTWARE, HARDWARE OR SYSTEM WILL AT ANYTIME BE UNINTERRUPTED OR ERROR-FREE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EIRCOM OR ITS SUPPLIERS BE LIABLE TO ME OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, PUNITIVE OR SPECIAL DAMAGES WHATSOEVER, WITHOUT REGARD TO CAUSE OR THEORY OF LIABILITY (INCLUDING, WITHOUT LIMITATION, DAMAGES INCURRED FOR LOSS OF BUSINESS PROFITS OR REVENUE, LOSS OF PRIVACY, LOSS OF USE OF ANY COMPUTER OR SOFTWARE INCLUDING THE SOFTWARE, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION OR OTHER PECUNIARY LOSS) ARISING DIRECTLY OR INDIRECTLY OUT OF ANY SESSION OR EIRCOM’S ACTIVITIES DURING THE SESSION, EVEN IF EIRCOM HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This Consent is governed by the laws of Ireland and he exclusive jurisdiction for any dispute will be the courts of Ireland.
